Who's Responsible for a Neighbor's Tree in Florida?

Crew trimming a large tree near a house

Your neighbor's tree is dropping leaves in your pool, hanging over your roof, or leaning toward your house. What can you do about it, and who pays? Here's a plain-English overview of how it generally works in Florida. (This is general information, not legal advice. For a specific dispute, talk to an attorney.)

Can I Trim Branches Hanging Over My Property?

Generally, yes. In Florida, you can usually trim branches and roots that cross onto your side of the property line, at your own expense, as long as:

  • You only cut back to the property line
  • You don't go onto your neighbor's property without permission
  • You don't damage the health of the tree or kill it

Cutting so much that the tree dies could make you responsible for it. That's why it's worth having a pro do it properly.

Who Pays If a Neighbor's Tree Falls on My House?

It usually depends on the condition of the tree:

  • A healthy tree knocked down by a storm: This is usually treated as an act of nature. In most cases, your own homeowners insurance handles damage to your property.
  • A dead, dying or obviously dangerous tree: If the owner knew, or should have known, the tree was hazardous and did nothing, they may be responsible.

If You're Worried About a Neighbor's Tree

  1. Talk to your neighbor first. Many don't realize there's a problem.
  2. Put it in writing. If the tree looks dead or dangerous, send a dated letter or email with photos. It creates a record that they were notified.
  3. Offer to split the cost. Sharing a trim or removal is often the fastest fix.
  4. Check your HOA rules if you're in a community association.

What About Removing a Dangerous Tree?

Florida law limits local governments from requiring a permit or fee to trim or remove a tree on residential property when an ISA Certified Arborist or a Florida licensed landscape architect documents that it poses a danger to people or property. That documentation is worth getting if a tree is clearly hazardous.
